K-tel

Getting harassed about copyright infringement issues from blogger by http://www.chillingeffects.org, but I don't know exactly what they are yet, all I know is that Explosive Radio Hits1978 and Teaser (which only similar artist on them is Elton John) have been removed. Until I know what exactly is the issue, this will only be this post on the blog.

It may be the last post , so I'd like to say thanks to contributors Deutros, Captian Goodvibes, Daz, Oldshepp, mum :-), Virgina, Bromlyn and special thanks to big Al.

Google owns Blogger. As far as I know all DMCA notices received by Google are automatically copied to the Chilling Effects site.

Blogger should only be concerned about infringing files that are hosted on their service (Blogger) - perhaps images of the K-Tel logo, or album covers. Infringing files (eg. music) hosted on other sites is none of their concern, particularly if those sites are not US-based. The DMCA does not apply to sites outside the US, eg. Rapidshare.

To rephrase:

Blogger (and the DMCA) really has no business telling you what you can and can't link to.

But fair enough if some of the images (hosted by Blogger) are infringing (even if they are 30 years old...)

Worth doing a counter-notification, if you can be bothered. Other alternative is to just move your blog so it's hosted somewhere else - perhaps outside of the US ;)

Just when I found a blog I really liked. Oh, the memories. Best of luck and a big "two fingers in the air" to the likes of the blokes with their copyright issues. This shite is old. KTEL should be thankful for the generous service you all were doing for them.

I think the posting actual files on sites like rapidshare if you want to avoid this.......

If I were "documenting" subject matter as this I would perhaps try to find working torrents on "The Pirate Bay" or the like and post links to the torrents on those sites instead. The DMCA seems not to be able to intimidate these sites so much.

Also since you do not host the torrents (and was not the one toupload them there ;-p) the DMCA cant touch you. If they try sue them for harassment and defamation

The DMCA, being US based, while seeminly justified in their investigations following reports/allegations of breaching any of their acts, really shouldn't be sticking their noses into stuff that does not apply to their constitutional amendments, or is outside US.

Someone obviously has way too much time on their hands to even bother with reporting you to DMCA. So lame. Really. We are Aussies, not Americans, we shouldn't be dictated to - because we have our OWN copyright legislation regarding website content and disclaimers regarding copyright were already in place.

I personally do not see what the fuss is about, unless you are served with a C&D I'd strongly suggest you take it up with those people responsible and/or file a counter notification if you want closure to this, because it's utterly ridiculous.

In any event, many thanks for the classic stuff from blogspots like this and others - 2 thumbs up! :D

Hope you get this bs sorted out soon.

The name of your blog is what probably caused a red flag and they sent someone to investigate. You might want to consider renaming your blog or start a new one.
